Welcome to Motzairt. These Terms of Service (“Terms”) govern your use of motzairt.com and the AI music generation services we provide (collectively, the “Service”). The Service is operated by Corey Cazares, a sole proprietor located at 107 Country Meadow, Canyon Lake, Texas, USA (“Motzairt,” “we,” “us,” or “our”).
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.
Motzairt generates custom songs using artificial intelligence based on inputs you provide (genre, type, script, personalization details, etc.). You preview the generated song before purchase, and unlocking it for download requires a one-time payment.
All sales are final. Because you have the opportunity to preview the generated song before purchase, no refunds will be issued once a song is unlocked.
See our Refund Policy for full details, including the limited circumstances where we may issue a refund (e.g., a confirmed technical failure that prevents delivery of the unlocked file).
When you unlock a song, we grant you a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, distribute, modify, and create derivative works of that song for personal and commercial purposes, subject to the limitations below.
Generated songs are stored on our servers for seven (7) days after creation, then permanently deleted. Download and save any unlocked song within that window — we cannot recover deleted files.
You are solely responsible for the content of your inputs (prompts, scripts, personalization details). You agree not to submit inputs that:
We reserve the right to refuse, remove, or reject any input or generated output at our sole discretion, without refund where prohibited content is involved.
The Service integrates with third-party services including Stripe (payments), Suno (or our AI generation provider), Netlify (hosting), and Meta (advertising/analytics). Your use of these is also governed by their respective terms and privacy policies. We are not responsible for third-party services.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ABOUT THE QUALITY, COPYRIGHTABILITY, OR ORIGINALITY OF GENERATED SONGS.
We do not guarantee uninterrupted, error-free, or secure operation of the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTZAIRT (AND ITS OWNER, AGENTS, AND AFFILIATES) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.
Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) $50 USD.
You agree to indemnify and hold harmless Motzairt and its owner from any claims, damages, losses, or expenses (including attorneys’ fees) arising from your use of the Service, your inputs, your use of generated songs, or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (IP, disclaimers, liability, indemnification, governing law) will survive.
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Comal County, Texas, and you consent to the jurisdiction of those courts.
We may update these Terms at any time. The “Last Updated” date reflects the latest revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
